The Supreme Court is about to hear West Virginia v. Environmental Protection Agency, a case that could prove extremely consequential for the government’s ability to combat climate change. The case is looking at whether or not the federal Clean Air Act will authorize Obama’s Clean Power Plan (which was never implemented) and if the EPA’s ability to reduce greenhouse gas emissions would be severely curtailed. The ruling could actually strip the EPA and Congress both of the ability to effectively protect the environment and even alter the structure of the government so that it would remove the government’s power on issues as wide reaching as workplace safety, overtime pay, and more.
